I need settlement help

Insurance update:

Despite being pretty much against personal injury lawsuits and whatnot, the other insurance company wants to convince me to sign away my right to sue the (really nice) girl who accidentally hit me. He was successful in outlying some reasonable things that I shouldn’t feel bad about being compensated for, and did a fair deal towards convincing me of some things that I still might feel bad for.

I’m meeting with him on Friday to discus things and come up with a dollar amount, so my question for y’all is:

What is a REASONABLE dollar amount to compensate me for sitting at the hospital from 7pm til Midnight on a weeknight, where I had to suffer through copius amounts of offensive television — such as American Inventor and that American Idol-type show where people compete with really awful celebrity impersonations — and unbearably stinky and sick people?

Keep in mind that I just want the compensation they’re insisting I deserve, not to participate in the unreasonable exploitation of insurance that ensures we all have to pay too much for our premiums.

If the other insurance company’s people are actually pushing you to settle quickly, be aware that it’s probably so that you’ll have to sign off on any future claims. I wouldn’t do it. You’re under no obligation to resolve anything on anyone’s timetable but your own, and your injury is still fresh enough that you could conceivably have problems from it.

If it’s YOUR insurance company trying to get you to settle…I don’t know what to say in that case. Shouldn’t matter to them, because they can expect to collect from the other company anything they put out on your behalf.

If you MUST, then don’t go overboard with it. Personally, I’d do double what I’d have made if I were at work, essentially ten hours of pay.

Plus a bit more for genera nuisance.

Usually it depends on the degree of damage to both the vehicle and to you. What was the nature of the accident? Front end? rear end? side-swipe? t-bone? Was the car totalled or just damaged and repaired? How are you physically? Are you receiving any on-going treatment such as physical therapy? Did you miss any work because of appointments and such? All of that will be used to calculate a "pain and suffering" compensation.

As a previous commenter noted, if the accident was recent, you’ll want to wait and see if there’s any lingering complications. Under WA law, you have 12 months to settle any claim without the necessity of filing a lawsuit. If you have time, I’d wait.

I’ve been through this, about 5 years ago. My advice is to wait. As Darth said, you have time, and you should take it. Don’t sign anything, don’t accept any payment. See how things shake out for you.
